What is the L-1 Visa?

The L-1 Visa is a non-immigrant visa that allows multinational companies to transfer executives, managers, or employees with specialized knowledge from an overseas office to a U.S. office. The L-1 Visa is ideal for businesses looking to expand their operations into the U.S. or for companies with existing U.S. operations needing to bring in key foreign employees.

There are two types of L-1 Visas:

  • L-1A Visa: For executives or managers.
  • L-1B Visa: For employees with specialized knowledge of the company’s products, processes, or management.

Who is Eligible for the L-1 Visa?

To qualify for the L-1 Visa, both the employee and the employer must meet specific criteria:

  • Employee Requirements:
    • The employee must have worked for the multinational company outside of the U.S. for at least one continuous year within the last three years.
    • The employee must be entering the U.S. to work in an executive, managerial, or specialized knowledge role.
  • Employer Requirements:
    • The U.S. company must have a qualifying relationship (such as a parent, branch, subsidiary, or affiliate) with the overseas company.
    • The employer must continue doing business in the U.S. and at least one other country during the period of the employee’s stay in the U.S.

What is the L-2 Visa?

The L-2 Visa is available to the spouse and unmarried children under the age of 21 of L-1 Visa holders. The L-2 Visa allows family members to live in the U.S. while the L-1 visa holder is working.

Benefits of the L-2 Visa:

  • Work Authorization: L-2 Visa holders (spouses) can apply for employment authorization to work in the U.S.
  • Study: L-2 Visa holders can enroll in educational programs in the U.S. during their stay.
  • Dependents: L-2 Visa holders can travel in and out of the U.S. during the duration of the visa.

How to Apply for the L-1 and L-2 Visa

  1. Employer Submits Petition: The U.S. employer must file Form I-129 (Petition for a Nonimmigrant Worker) on behalf of the employee applying for the L-1 Visa.
  2. Submit L-2 Visa Application: Once the L-1 Visa petition is approved, spouses and children can apply for the L-2 Visa.
  3. Attend Visa Interview: Both the L-1 and L-2 Visa applicants must attend an interview at the U.S. Embassy or Consulate in their home country.
  4. Receive Approval: Upon approval, the visas will be stamped in the applicants’ passports, allowing entry to the U.S.

Duration and Extensions

  • L-1A Visa: The initial period of stay is up to 3 years, with the possibility of extension for up to 7 years.
  • L-1B Visa: The initial stay is granted for up to 3 years, with possible extensions up to 5 years.
  • L-2 Visa: The duration is tied to the validity of the L-1 Visa.
